The regulation of the appeals' system has several deficiencies more or less noticeable, that in our belief are related to two fundamental issues. On one hand, marked by characteristic gaps in its regulations, registering complete aspects that are not covered by any regulation or receive an incomplete treatment; and on the other, having an extremely restrictive and weak (ineffective) character of the same appealing system as a whole and particularly regarding the appeal for annulment. This essay deals with this last characteristic which will be examined through three judgments passed by the Appeals Court of La Serena.La regulación del sistema de recursos tiene diversas deficiencias más o menos acusadas, que a nuestro juicio están relacionadas con dos cuestiones fundamentales. Por una parte, con una marcada característica lagunar de su normativa, registrándose aspectos completos que no reciben regulación o reciben un tratamiento incompleto o inacabado, y, de otra, con un carácter extremadamente restrictivo y débil (ineficaz) del mismo sistema recursivo en su conjunto y en particular del recurso de nulidad. El presente ensayo se centrará en esta última característica, la que se examinará a través de tres sentencias dictadas por la Ilustrísima Corte de Apelaciones de La Serena.
