dc.description	This case note deals with a judgment delivered by the Supreme Court in 2018, in which it was understood that the phrasing “with the acquiescence of the landowner”, contained in the second part of article 669 of the Civil Code does not only refers to the knowledge of the landowner, but demands an additional element: a manifest or apparent authorization from her. Contrary to what the Supreme Court declared, this interpretation does not find support in the work of the jurist Luis Claro Solar.	en-US
dc.description	Se comenta una sentencia de la Corte Suprema del año 2018, en la que se entendió que la expresión “a ciencia y paciencia del dueño del terreno”, contenida en el inciso segundo del artículo 669 del Código Civil, se refiere no solo al conocimiento del dueño del terreno, sino que requiere un elemento adicional: la autorización expresa o aparente de éste. Contrario a lo sostenido por la Corte Suprema, esta interpretación no tiene asidero en el trabajo del jurista Luis Claro Solar.	es-ES
