dc.description	On the occasion of the dictation of the Judgment of the Court of Justice of the European Union in the matter called the "legislative vacation", some of the questions that it has raised in the doctrine are examined; notably, the theory of the reserve of Administration and administrative discretion. Finally, the author proposes that this ruling responds to a progressive constitutional mutation that has been taking place in the internal legal systems of the Member States as a result, in this case, of the transfer of competences to the European Union, which entails modifying –in the matters that have been intervened by said supranational instance– the role that the traditional conception assigns to the legislative power.	en-US
dc.description	Con ocasión de la dictación de la Sentencia del Tribunal de Justicia de la Unión Europea en el asunto denominado las “vacaciones legislativas”, se examinan algunas de las cuestiones que la misma ha suscitado en la doctrina; señaladamente, la teoría de la reserva de Administración y la discrecionalidad administrativa. Por último, el autor plantea que aquella sentencia responde a una progresiva mutación constitucional que se ha ido produciendo en los ordenamientos jurídicos internos de los Estados miembros a consecuencia, en este caso, de la transferencia de competencias a la Unión Europea, lo cual comporta modificar –en las materias que han sido intervenidas por dicha instancia supranacional– el papel que la concepción tradicional le asigna al poder legislativo.	es-ES
