dc.description | The research analyzes the relationship between legal interpretation and translation proposed by the School of Genoa. In particular, the work of Riccardo Guastini is analysed. The study questions that the relationship between legal interpretation and translation is an analogy as Guastini says. The theory of structural mapping from cognitive linguistics is used. The conclusions do not criticize the Genoese theory of legal interpretation, but rather present a description of a blind point in the theory. They also discuss the need to analyse the central works of the theory of law, from the point of the literary and rhetorical figures that unfold in the argument, to highlight the modes of thought involved in the use of these figures | en-US |
dc.description | La investigación analiza la relación entre la interpretación jurídica y la traducción que postula la Escuela de Génova. En particular se analiza la obra de Riccardo Guastini. El estudio cuestiona que la relación entre interpretación jurídica y traducción sea una analogía tal como afirma Guastini. Se usa la teoría del mapeo estructural proveniente de la lingüística cognitiva. Las conclusiones no critican la teoría genovesa de la interpretación jurídica, sino que presentan una descripción de un punto ciego en la teoría. También discurren sobre la necesidad de analizar las obras centrales de la teoría del derecho, desde el punto de las figuras literarias y retóricas que se despliegan en la argumentación, para resaltar el modos de pensamiento implicados en el uso de estas figuras. | es-ES |
