| dc.description | El propósito de este trabajo es analizar los principios del derecho procesal laboral brasileño, considerando la posible incidencia del Código Procesal Civil en el ámbito de los procesos laborales. Con la constitucionalización del derecho, el análisis de las posibles implicaciones del Código Procesal Civil en el campo laboral no debe resultar del enfrentamiento directo entre estas ramas, pero debe ser mediado por el texto constitucional. Es fundamental que el nuevo orden contribuya al acceso a los derechos de forma eficaz y rápida. | dc.description | The purpose of this article is to discuss the principles of Brazilian Labor Procedural Law, considering the possible impact of the Civil Procedural Code in the labor procedural field. With the constitutionalization of law, the analysis of the possible implications of the new code in labor procedural should not result from direct confron tation between these two branches, but be mediated by the Constitution. It is essential that the new order will contribute to the access to rights in an effective and expeditious manner. The autonomy of Labor Procedural Law nowadays depends much more on its consolidation as a tool for the realization of constitutional values than their distance from Civil Procedural Law. | en-US |
