The proposal initiated by the Argentine Republic on April 21, 2009, regarding the extension of the outer limit of the continental shelf before the Commission on the Limits of the Continental Shelf (CLPC), would cause effects, the consequences of which would have important implications and variations of this maritime zone regulated by the 1982 Sea Convention, which, fully complying with the law, according to current international regulations, would be reorienting, from a geographical and ocean-political point of view, the position in terms of projection, of the sea floor and subsoil, of the oceanic presence demanded by the Argentine State. This, seen from the point of view of a preparatory act, regarding the Argentine claims on the Malvinas Islands and the Antarctic territory, both cases subject to pending foreign policy conditions and arranged in different legal grounds. Although the arguments presented fully comply with legal conditions based on resolutions and international treaties in force, the consequences of this initiative promoted by the Argentine Republic, in our opinion, embarrass or at least limit the interests and rights of Chile generated by it. action, on the one hand, due to the occurrence of marine overlaps observed over southern national waters and the sovereignty of Diego Ramirez Island; as well as the alteration of the principle of the territorial continuity of Chile over part of the Antarctic territory with which our country maintains an expectable situation from the historical, juridical- diplomatic and geopolitical point of view, all arguments recognized by the international community.El planteamiento iniciado por la República Argentina el 21 de abril de 2009, en cuanto a la extensión del límite exterior de la plataforma continental ante la Comisión de Límites de la Plataforma Continental (CLPC), provocaría efectos, cuyas consecuencias tendrían implicancias y variaciones importantes de esta zona marítima regulada por la Convención del Mar de 1982, la que ajustándose plenamente a derecho, según la normativa internacional vigente, estaría reorientando, desde el punto de vista geográfico como oceanopolítico, la posición en términos de proyección, del suelo y subsuelo marino, de la presencialidad oceánica demandada por el Estado argentino. Esto, mirado desde el punto de vista de un acto preparatorio, en cuanto a las pretensiones argentinas sobre las Islas Malvinas y el territorio antártico, ambos casos sujetos a condiciones de política exterior pendientes y dispuestos en causales jurídicas distintas. Si bien los argumentos expuestos, se ajustan plenamente a condiciones jurídicas fundadas en resoluciones y en tratados internacionales vigentes, las consecuencias de esta iniciativa impulsada por la República Argentina, a nuestro juicio, embarazan o al menos limitan los intereses y derechos de Chile generados por esta acción, de una parte por la ocurrencia de superposiciones marinas que se observan sobre aguas nacionales australes y la soberanía de la Isla Diego Ramírez; así como la alteración del principio de la continuidad territorial de Chile sobre parte del continente antártico con el cual nuestro país mantiene una situación expectable desde el punto de vista histórico, jurídico- diplomático y geopolítico, todos argumentos reconocidos por la comunidad internacional.
