dc.description	This article discusses the power that labor judges have to make to the witnesses the questions they deem necessary for the elucidation of the facts, according to the provisions in article 454 No. 6 of the Chilean Labour Code. That power is analyzed under the perspective of the guarantees required bydue process, also considering the nature and epistemic quality of testimony as evidence, after which it is concluded that labor judge's interrogation of witnesses violates procedural equality and impartiality of the adjudicator, being this the reason why judges should only seek formal clarification of ambiguous or unintelligible witness declarations.	en-US
dc.description	El presente artículo aborda la facultad que poseen los jueces del trabajo para formular a los testigos las preguntas que estimen necesarias para el esclarecimiento de los hechos, de conformidad a lo preceptuado en el artículo 454 N° 6 del Código del Trabajo. Dicha facultad es analizada desde la óptica de las garantías exigidas por el debido proceso, teniéndose en cuenta, asimismo, la naturaleza y calidad epistémica de la declaración testimonial como medio de prueba, al cabo de lo cual se concluye que la interrogación oficiosa de los testigos en sede laboral vulnera la igualdad procesal y la imparcialidad del juzgador, pudiendo los jueces únicamente solicitar la aclaración formal de los dichos ambiguos o ininteligibles del testigo.	es-ES
