This article presents the results obtained from a critical discourse analysis around the legal figure of trusted employees under the criteria of section «A» within the article 123 in Mexico’s constitution. The corpus consisted of the corresponding texts in the Constitution (CPEUM for its acronym in Spanish), as well as the current Federal Labor Law. The analysis was accomplished through two different discursive materialities, which allowed identifying those references, connections, and inconsistencies, among the legal texts that allow us to account for the complexity that represents the understanding of the legal figure analyzed; On the other hand, attention was paid to those aspects that seemed to establish an unequal relationship between the actors in the tripartite relationship in the workplaceEste artículo presenta los resultados de un análisis crítico del discurso en torno a la figura jurídica de los trabajadores de confianza que están al amparo del apartado «A» del artículo 123 constitucional en México. El corpus estuvo integrado por los textos correspondientes en la Constitución Política de los Estados Unidos Mexicanos (CPEUM), así como de la Ley Federal del Trabajo vigente. El análisis se realizó mediante dos diferentes materialidades discursivas que permitieron identificar aquellas referencias, conexiones e inconsistencias entre los textos legales, y que dan cuenta de la complejidad que representa el entendimiento de la figura jurídica analizada; por otra parte, se prestó atención a aquellos aspectos que parecieran establecer una relación desigual entre los actores de la relación tripartita del ámbito laboral.
