| dc.description | The article intends to understand the concept of work degradation adopted by the Inter-American Court of Human Rights (HDI Court), based on Brazil’s condemnation in the case of Fazenda Brasil Verde, compared to what has been understood on the subject by the Regional Court Federal District 5 (TRF5), especially in relation to the sugar and alcohol sector in Pernambuco. Then, the judgment of the Inter-American Court was analyzed in the above case and 12 cases of the TRF5 jurisprudence. The research uses the inductive method and the technique of collecting bibliographic and documentary data. Thus, it was realized that sugarcane because they are in a vulnerable situation are exploited and subjected to degrading work conditions, contrary to the construction of the Inter-American Court on decent work. | en-US |
| dc.description | O artigo pretende compreender o conceito de degradância no trabalho adotado pela Corte Interamericana de Direitos Humanos (Corte IDH), a partir da condenação do Brasil no caso da Fazenda Brasil Verde, comparativamente com o que vem sendo entendido sobre o assunto pelo Tribunal Regional Federal da 5° Região (TRF5), sobretudo em relação ao setor sucroalcooleiro de Pernambuco. Então, analisou-se a sentença da Corte IDH no caso acima exposto e 12 casos da jurisprudência do TRF5. Na pesquisa utiliza-se o método indutivo e técnica de coleta de dados bibliográfica e documental. Assim, percebeu-se que canavieiros por se encontrarem em situação de vulnerabilidade são explorados e submetidos a condições degradantes de trabalho, contrariando a construção da Corte IDH sobre trabalho digno. | es-ES |
