| dc.description | Ad portas de la redacción de una nueva Constitución, y en el contexto de la actual discusión de dos proyectos de ley (en materia de biodiversidad y cambio climático) sobre el reconocimiento expreso del principio de no regresión en materia ambiental, este trabajo busca determinar el estado del arte en relación con el reconocimiento de este principio a nivel internacional y comparado. Se revisan las fórmulas de su reconocimiento, los principales aportes de la doctrina y la jurisprudencia en cuanto a su contenido, alcance y límites. Se caracterizan dos versiones del principio, en cuanto a los requisitos que lo hacen procedente, aunque ambas exigen una especial motivación de la decisión: la ciencia deberá ser capaz de demostrar que la aparente regresión no implica un debilitamiento importante de la protección ambiental. Además, respecto de Chile, se entregan fundamentos para su reconocimiento, se revisan casos que podrían calificarse de «regresivos» y se comparan las versiones que del principio consideran los dos proyectos de ley comentados. | es-ES |
