The paper analyzes the most important theories that have been proposed to justify the so-called crimes of implicit danger; that is, the criminalization of behaviors that, in general, unleash a risk of harm to indeterminate interests, although there may be particular circumstances in which this kind of conduct does not provoke such a risk. After a critical review of different proposals, this paper supports the perspective that understands these crimes as rebuttable presumptions. Although this approach has been supported in the past, the paper provides arguments that allow us to understand better its advantages as well as to respond to the objections raised against it. In particular, it is argued that the view of crimes of implicit danger as rebuttable presumptions can maximize the advantages of resorting to this legislative technique, since it exploits largely the benefits of rules, without substantially increasing its unfair consequences.en-US
