This article tries to solve two of the problems that are noticed in the interpretation of the administrative contract, given the normative dispersion and the lack of contentious-administrative courts that allow condensing this matter. A first problem is the indeterminacy of the legal regime applicable to administrative contracts in the execution phase, for which, based on the previous contributions of the doctrine, I am going to start by proposing criteria that allow to differentiate between the administrative contract in the strict sense and the private contract of the Administration. A second problem is the preeminent use of civil rules that, together with the alleged general supplementary nature of the Civil Code, raise the need to review the supplementary legal status of administrative contracts in silence of express rule, for which I am going to base the interpretation based on the rules and principles of contracting in public law and the supplementary application of civil rules in the absence of the foregoing.El presente artículo intenta resolver dos de los problemas que se advierten en la interpretación del contrato administrativo, dada la dispersión normativa y la carencia de tribunales contencioso administrativos que permitan condensar esta materia. Un primer problema es la indeterminación del régimen jurídico aplicable a los contratos administrativos en la fase de ejecución, para lo cual, tomando como base los aportes previos de la doctrina, voy a partir por proponer criterios que permitan diferenciar entre el contrato administrativo en sentido estricto y el contrato privado de la Administración. Un segundo problema es el uso preeminente de reglas civiles que, en conjunto con la pretendida supletoriedad general del Código Civil, plantean la necesidad de revisar el estatuto jurídico supletorio de los contratos administrativos en silencio de regla expresa, para lo cual voy a fundamentar la interpretación preferente en base a reglas y principios de la contratación en el Derecho público y la aplicación supletoria de reglas civiles en defecto de lo anterior.
