The Church XI century change (Gregorio VII and the ecclesiastical university) and the new Imperial "civilitas" were the bases for the development of the iuris system of Ius Commune. This way we can understand that the legal species that were born during the XIII century and developed until the XVI century, the Summae Confesorum (real iure civile and iure canonico treaties) were the origins and causes of development for the criminalJigurae, elaborated by jurists from the ratio vitanda peccati; jurists that never forgot that serving as guides for the confessors was their main business.El 'cambio' del siglo XI en la Iglesia (Gregorio VII y la universalidad eclesifistica), y la nueva "civilitas" en el Imperio supusieron los pilares de desarrollo de la societas christiana medieval en Europa sobre el sistema iuris del derecho común. La salus animarum se convirtió en objetivo prioritario de la sociedad medieval. Así se entiende la elaboración del género jurídico nacido a partir del siglo XIII y desarrollado hasta el XVI: la Summa confessorum. Las obras que lo constituyen son verdaderos tratados iure civile y iure canonico; en ellas se incluyeron las principales figurae criminales configuradas por los juristas en virtud de la ratio vitanda peccati  y no perdieron de vista que su principal objetivo fue servir de guia al confesor en el tribunal de la penitencia.
