| dc.description | Since the reform of the National Constitution in 1994, Argentinian provinces must recognize municipal autonomy in their constitutions in the institutional, political, administrative and economic order. More than twenty years after the reform was instituted, some provinces continue to violate the Constitution, which has led to unfortunate consequences for local governments. This paper focuses on the case of Mendoza, making note of the need to promote a comprehensive reform of the municipal regime that includes the recognition of the municipal constituent power and guarantees the right to inter-municipal association. Based on these developments, it reflects on the most relevant legal restrictions that hinder the implementation of inter-municipal partnership projects, for the purposes of determining the degree of autonomy that municipalities actually hold in the province and to suggest criteria for the strengthening of the institutional capacity of local governments in Mendoza. | en-US |
| dc.description | Luego de la reforma de la Constitución Nacional de 1994, las provincias argentinas se encuentran obligadas a reconocer la autonomía municipal en sus constituciones en el orden institucional, político, administrativo y económico-financiero. Transcurridos más de veinte años luego de la reforma, algunas provincias aún incumplen el mandato constitucional, lo que ha generado consecuencias lamentables para sus gobiernos locales. El presente trabajo se focaliza en el caso de Mendoza, advirtiendo acerca de la necesidad de promover una reforma integral de su régimen municipal que contemple el reconocimiento del poder constituyente municipal y garantice el derecho de asociación intermunicipal. En función de estos desarrollos, se reflexiona en torno a las restricciones normativas más relevantes que dificultan la ejecución de proyectos asociativos de carácter intermunicipal, a los efectos de determinar el grado de autonomía que efectivamente detentan los municipios en la provincia y de sugerir criterios para fortalecer las capacidades institucionales de los gobiernos locales de Mendoza. | es-ES |
