It is proposed to analyze the figure of the as-signment and transmission of litigious rights from a completely new point of view: investigating the reasons that justify the regulation that the Chilean legislation has imposed on this institute.Therefore, three aspects of this figure are specially attended. First, the moment since the right in dispute, acquires the character of litigious. Sec-ond, the right recognized to the debitor to release from the assignment. In third place, the way in which the transfer materializes within the litigation. Following, we refer to the regulation of this figure, analyzed from the ethical point of view, pursuing to characterize the scope of the institute and its consequences. And finally, we analyze a catalog of related figures to the central issue of this article which differ in some substan-tial aspects.Se propone analizar la figura de la cesión y transmisión de derechos litigiosos desde un punto de vista completamente nuevo: indagando las razones que justifican la regulación que la legislación chilena ha impuesto a este instituto.Tres aspectos de esta figura son especialmente atendidos. Primero, el momento desde que el derecho adquiere el carácter de litigioso. En segundo lugar, el derecho de retracto que surge en favor del demandado. Y en tercer lugar, la forma en que se materializa la cesión dentro del litigio. Luego, se analizarán algunos aspectos de la figura desde el punto de vista ético profesional para caracterizar correctamente el alcance del instituto y sus consecuencias. Finalmente, analizamos un catálogo de figuras relacionadas con el instituto central de esta obra que difieren en algunos aspectos esenciales. Se dedica un apartado especial a una figura extranjera de creciente interés en nuestro país, pero carente de regulación, conocida como "financiamiento de litigios por terceros”.
