| dc.description | The mining easement is essentially temporary. It is delimited by virtue of the use made of the dominant property, so it is necessary that at the time of its constitution the useful life of the mining operation projected by the mining concessionary be determined in advance, thus allowing the identification of the temporary extension of the lien that is sought to be imposed on the servant property, as well as adequately quantify the damages that the owner of the latter will have the right to receive by way of compensation. At present, serious adverse legal effects are generated to the interests of the owner of the servant property, since there are no legal norms that allow establishing the time limit at the time of constituting this type of easement, the transitory nature that is characteristic of them is distorted, mutating to an ineffable indeterminate extension of them, which also results in the non-specificity of the damages that must be compensated to the owner of the property. | en-US |
| dc.description | La servidumbre minera es esencialmente transitoria. Ella está delimitada en virtud del aprovechamiento que se efectúe del predio dominante, por lo que resulta necesario que al momento de su constitución se determine anticipadamente la vida útil de la operación minera proyectada por el concesionario minero, lo cual permitirá identificar la extensión temporal del gravamen que se busca imponer al predio sirviente, como también, cuantificar adecuadamente los perjuicios que el titular de éste último tendrá derecho a percibir a título de indemnización. En la actualidad, se generan graves efectos jurídicos adversos a los intereses del propietario del predio sirviente, toda vez que al no existir normas legales que permitan establecer el límite temporal al momento de constituirse este tipo de servidumbres, se desnaturaliza la transitoriedad que les es característica, mutando a una inefable prolongación indeterminada de las mismas, lo que redunda, además, en la inespecificidad de los perjuicios que se deban resarcir al dueño del predio. | es-ES |
