While the obligation to refer the parties to arbitration has been recognized by Chilean jurisprudence, doubts persist as to the scope of the examination to be carried out by the state court for such purposes under Article 8 of Law No. 19,971 and Article II.3 of the New York Convention of 1958. The above is related to thereception of the kompetenz-kompetenz principle, in particular its negative effect. The judgment of the Supreme Court analyzed in this paper sheds some light on the matter, leaning, in the author’s opinion, towards the thesis that such examination must be of a prima facie nature. Si bien el deber de remitir a las partes a arbitraje ha sido reconocido por la jurisprudencia chilena, las dudas persisten en torno al alcance del examen que debe efectuar el juez estatal para tales efectos bajo el artículo 8 de la Ley N° 19.971 y el artículo II.3 de la Convención de Nueva York de 1958. Lo anterior dice relación con la recepción del principio kompetenz-kompetenz, en particular su efecto negativo. La sentencia de la Corte Suprema que se analiza en el presente trabajo arroja algunas luces al respecto, acercándose, en opinión del autor, a la tesis de que dicho examen debe ser uno de naturaleza prima facie.
