| dc.description | The transition from the Viceroyalty to the Republic meant a transformation of the legal and cultural paradigms that hadregulated the life of the Peruvian Indians. The Hispanic Monarchy, having a plural and corporate character and being imbued with a post-Tridentine Catholic culture, establisheda legal regime that recognized the human dignity of the indigenous, as well as their legal privileges and community rights as “miserable” and vassals of the Crown. The Bourbon Reforms and the Constitution of Cadiz (1812) initiated a shift towards an enlightened conception that favoured the individual over the social body. After independence, guided by a liberal vision, Peruvian legislators, opposed to the tutelary laws of the Viceroyalty, sought to convert Indians into citizens and owners by recognizing their legal equality and individualownership of their lands. However, these laws deepened the marginalization and fragility of the rural population. Duringthe first decades of the twentieth century, these problems gave rise to a broad national debate that was taken up again during the government of Augusto B. Leguía (1919-1930), who promoted a new tutelary legislation that, within the framework of legal pluralism, recognized the subjectivity andcommunity rights of the Peruvian Indian. | en-US |
| dc.description | El paso del Virreinato a la República supuso una transformación de los paradigmas legales y culturales que habían regulado la vida del indígena peruano. La Monarquía Hispánica, teniendo un carácter plural, estamental y, estando imbuida en una cultura católica postridentina, estableció un régimen jurídico que reconoció la dignidad humana del indígena, así como sus privilegios legales y derechos comunitarios en calidad de “miserables” y de vasallos de la Corona. Las Reformas Borbónicas y la Constitución de Cádiz de 1812 iniciaron un giro hacia una concepción ilustrada que privilegió al individuo sobre el cuerpo social. Después de la independencia, guiados por una visión liberal, los legisladores peruanos, opuestos a las leyes tutelares del Virreinato, buscaron convertir al indio en ciudadano y propietario reconociendo su igualdad legal y la propiedad individual de sus tierras. Sin embargo, estas leyes ahondaron la situación de marginación y fragilidad de la población rural. Durante las primeras décadas del siglo XX estos problemas suscitaron un amplio debate nacional que se retomó durante el gobierno de Augusto B. Leguía (1919-1930), el cual promovió una nueva legislación tutelar que, en el marco de un pluralismo jurídico, reconoció la subjetividad y los derechos comunitarios del indio peruano. | es-ES |
