| dc.description | The objective of this article will be to cross-reference the concepts of responsibility, freedom, and action as they appear in works by Maurice Merleau-Ponty and Hanna Arendt. In particular, an attempt will be made to reflect on the possibility of reaching a new understanding of the scope of the concept of historical responsibility to think especially about the so-called "crimes against humanity." The general thesis will affirm the need to depart from the classical tradition that understands action as the prerogative of a free subject as rational; a subject who deliberates and decides, using the transcendental power of his understanding, to move to an understanding of responsibility and, therefore, of the criminal character of the act, based not on the evaluation of the subject's intention or the validity of his judgment, but in the concepts of situation and situated freedom. In summary, we wish to highlight that to judge the criminal nature of certain acts, the meaning that is completed a posteriori of the same, its historical meaning and not only or primarily, its a priori meaning, the intention that initiates them, must be evaluated. | en-US |
| dc.description | El objetivo del presente artículo será realizar un cruce entre los conceptos de responsabilidad, libertad y acción tal como aparecen en obras de Maurice Merleau-Ponty y Hanna Arendt. En especial, se intentará reflexionar sobre la posibilidad de llegar a una nueva comprensión del alcance del concepto de responsabilidad histórica para pensar Especialmente los llamados” crímenes contra la humanidad” La tesis general afirmará la necesidad de apartarse de la tradición clásica que entiende la acción como prerrogativa de un sujeto libre en tanto racional; sujeto que delibera y decide, utilizando La potencia trascendental de su entendimiento, para pasar a una comprensión de la responsabilidad y, por lo tanto, del carácter criminal del acto, basada no en la evaluación de la intención del sujeto o en la validez de su juicio, sino en los conceptos de situación y libertad situada. En síntesis, se desea resaltar que para juzgar el carácter criminal de ciertos actos debe evaluarse el sentido que se completa a posteriori de los mismos, su sentido histórico y no solo ni primariamente, su sentido a priori, la intención que los inicia. | es-ES |
