This article analyzes two types of femicide using legal categories of crime development, frustrated and consummated, between 2018 and 2020 in the Metropolitan Region (RM), a period in which new and fundamental laws were approved to protect women from this type of domestic violence (DV). Understanding that there are multiple variables, this work pays attention to the “previous complaint(s)” of women who have suffered a frustrated femicide, understanding that this action demonstrates a real awareness of the DV, they repeatedly experience. However, for consummated femicides, the total number of cases will be considered. The objective is to analyze the behavior of these women in relation to their rights and the support of the system. My study shows that in frustrated femicides, there is a very high number of women who had previous complaints and precautionary measures. On the other hand, in consummated femicides, previous complaints are almost nonexistent. We worked with 38 cases of attempted femicide with previous complaints, and the 37 consummated femicides. Furthermore, “listening” to the voices of these women, it is concluded that there is a lack of coordination between legal advances and the judicial system, being the function of the latter to favor these changes. The files of the 75 cases were reviewed in the Unified Causes Registry of the Judiciary.Este artículo analiza dos tipos de femicidio desde categorías legales de desarrollo del delito, frustrado y consumado, entre 2018 y 2020 en la región Metropolitana (RM), período en que nuevas y fundamentales leyes fueron aprobadas para proteger a la mujer de este tipo de violencia intrafamiliar (VIF). Entendiendo que hay múltiples variables, este trabajo presta atención al factor “denuncia(s) previa” de la mujer que ha sufrido femicidio frustrado, entendiendo que esta acción es una demostración de consciencia real de la VIF que vive repetidamente. Sin embargo, para los femicidios consumados se considerará el total de los casos. El objetivo es analizar el comportamiento de estas mujeres víctimas, en relación a sus derechos y los medios de apoyo del sistema. Mi estudio manifiesta que en los femicidios frustrados hay un número altísimo de mujeres que contaban con denuncias y medidas cautelares previas. Por otro lado, en los consumados, la denuncia previa es casi inexistente. Se trabajó con los 38 casos de femicidios frustrados con denuncias previas y los 37 de femicidios consumados. Por otro lado, “escuchando” las voces de estas mujeres se concluye que hay una descoordinación entre los avances legales y el sistema judicial, pese a que la función de este último es favorecer los cambios. Se revisaron los expedientes de los 75 casos en el registro Unificado de Causas del Poder Judicial.
