dc.descriptionChile has experienced exponential growth in migration flows over the last decade, largely characterized by irregular migration. This has facilitated the development of trafficking networks run by organized criminal groups, exacerbating the violation of human rights of the migrant population. In this context, the article analyzes how certain policies have influenced the increase in irregular migration, migrant trafficking, and violations of their fundamental rights. Based on this contextual analysis, the study focuses on the criminal type of article 411 bis of the Penal Code, evaluating its adequacy to international standards to effectively punish this crime, and the consideration of the migrant as a victim and not only as an object of the crime, using at the same time the Spanish criminal type as a point of comparison. Based on what has been developed, adjustments to the criminal type are proposed in the area of ??its subjective element and in the established aggravating factors, as well as the incorporation of an exemption from liability.en-US
dc.descriptionChile ha experimentado un crecimiento exponencial en los flujos migratorios durante la última década, caracterizado en gran medida por la migración irregular. Esto ha facilitado el desarrollo de redes de tráfico a cargo de grupos delictivos organizados, agudizando la vulneración de derechos humanos de la población migrante. En este contexto, el artículo analiza cómo ciertas políticas han incidido en el aumento de la migración irregular, el tráfico de migrantes, y las vulneraciones a sus derechos fundamentales. A partir de este análisis contextual, el estudio se centra en el tipo penal del artículo 411 bis del Código Penal, evaluando su adecuación a los estándares internacionales para sancionar efectivamente este delito, y la consideración del migrante como víctima y no solo como objeto del delito, usando a la vez el tipo penal español como punto de comparación. En base a lo desarrollado, se proponen ajustes al tipo penal en el ámbito de su elemento subjetivo y en las agravantes establecidas, así como la incorporación de una eximente de responsabilidad.es-ES
dc.descriptionO Chile registou um crescimento exponencial nos fluxos migratórios ao longo da última década, em grande parte caracterizado pela migração irregular. Isto facilitou o desenvolvimento de redes de tráfico dirigidas por grupos criminosos organizados, exacerbando a violação dos direitos humanos da população migrante. Neste contexto, o artigo analisa como certas políticas influenciaram o aumento da migração irregular, do tráfico de migrantes e das violações dos seus direitos fundamentais. Com base nesta análise contextual, o estudo centra-se no tipo penal do artigo 411 bis do Código Penal, avaliando a sua adequação às normas internacionais para punir eficazmente este crime, e a consideração do migrante como vítima e não apenas como objeto de o crime, ao mesmo tempo que utiliza o crime espanhol como ponto de comparação. Com base no que foi desenvolvido, propõem-se ajustamentos à infração penal no âmbito do seu elemento subjetivo e nas circunstâncias agravantes estabelecidas, bem como a incorporação de uma isenção de responsabilidade.pt-BR
