dc.descriptionThis article proposes the design of a prejudicial interpretative mechanism within the framework of the Inter-American Human Rights System as a means to strengthen the uniform interpretation and application of conventional human rights instruments, based on the increasing interdependence between national and international legal orders and the need for enhanced cooperation among different jurisdictions. It argues that the incorporation of a judicial dialogue tool—similar to the European preliminary ruling mechanism, yet adapted to the particularities of the Inter-American System— would help ensure a more coherent and effective protection of human rights in the region. The proposal is grounded in the idea that such a mechanism could serve as a key element to prevent hermeneutic fragmentation and to foster a genuine inter-American legal community, not by displacing the interpretative responsibility of domestic judges, but by complementing their exegetical functions through the specialized guidance of the Inter-American Court of Human Rights. The proposal is formulated in de lege ferenda terms, taking into account the specific demands of the Inter-American System and the comparative lessons offered particularly by the experiences of the European Union and the Andean Community.en-US
dc.descriptionEste artículo propone el diseño de un mecanismo prejudicial interpretativo en el ámbito del Sistema Interamericano de Derechos Humanos (SIDH), como una vía para fortalecer la uniformidad en la interpretación y aplicación de los instrumentos convencionales en materia de derechos humanos, a partir de la creciente interdependencia entre los órdenes jurídicos nacionales e internacionales y la necesidad de una cooperación reforzada entre las distintas jurisdicciones. Se argumenta que la incorporación de una herramienta de diálogo judicial, semejante a la cuestión prejudicial europea, pero adaptada a las particularidades del SIDH, contribuiría a garantizar una tutela más efectiva y coherente de los derechos humanos en la región. De esta manera, se parte de que este mecanismo puede ser un elemento clave para evitar la fragmentación hermenéutica y fomentar una verdadera comunidad jurídica interamericana, sin desplazar la responsabilidad de los jueces nacionales, sino complementando sus funciones exegéticas mediante la orientación especializada de la Corte Interamericana de Derechos Humanos (Corte IDH). La propuesta se formula en términos de lege ferenda, atendiendo a las exigencias propias del SIDH y a las lecciones comparadas que ofrecen las experiencias de la Unión Europea y de la Comunidad Andina, particularmente.es-ES
dc.descriptionEste artigo analisará o papel transformador dos órgãos jurisdicionais no contexto do neoconstitucionalismo, onde os juízes passaram a exercer uma função ativa no controle normativo e na proteção dos direitos fundamentais, alcançando legitimidade por meio de suas decisões. Assim, a atividade exegética dos operadores judiciais exige uma abordagem argumentativa que vá além de uma interpretação meramente literal da norma, sendo necessária a utilização de diversas técnicas interpretativas e cânones hermenêuticos para assegurar sua correta interpretação e aplicação. Nessa dinâmica, o diálogo judicial desempenha um papel fundamental, pois não apenas facilita a cooperação no contexto da proteção multinível dos direitos, como também permite que os tribunais internos resolvam dúvidas concernentes aos instrumentos internacionais de proteção. Dentro desse contexto, propõe-se o desenho de um mecanismo prejudicial interpretativo que fortaleça o diálogo entre as jurisdições nacionais e a Corte Interamericana de Direitos Humanos, garantindo a interpretação e aplicação uniformes do direito internacional regional dos direitos humanos, no marco de um constitucionalismo dos direitos.pt-BR
