Abstract
The article systematizes the jurisprudence of the Inter-American Court of Human Rights on Article 26 of the American Convention and discusses the different approaches of the court to consider violations of economic, social, cultural, and environmental rights. It also highlights the most relevant aspects of the Inter-American Court of Human Rights jurisprudence for domestic law and for the consideration of national judges in Latin America. For this, based on selected cases, an analysis is carried out of the interpretative criteria used by the court to understand the scope of these rights and assess their compliance. El artículo sistematiza la jurisprudencia de la Corte Interamericana de Derechos Humanos (Corte IDH) sobre el artículo 26 de la Convención Americana y discute los distintos abordajes del tribunal para considerar violaciones a los derechos económicos, sociales, culturales y ambientales. Subraya también los aspectos más relevantes de la jurisprudencia de la Corte IDH para el derecho interno y para la consideración de los jueces nacionales de América Latina. Para esto, a partir de casos escogidos, se realiza un análisis de los criterios interpretativos empleados por el tribunal para entender el alcance de estos derechos y evaluar su cumplimiento.
