Abstract
This paper analyses the development and impact of conventionality control in Spain, considering how it is exercised by the various branches of government (legislative, executive and judicial). In the first part, the author explains the relatively novel nature of conventionality control in Spain. The second part tackles the establishment of such control through Constitutional Court Judgment 140 of 2018, as well as its inspiration from the Almonacid Case of the Inter-American Court of Human Rights. The third and fourth parts deal with recent and latest experiences of conventionality control in Spain before and after the aforementioned Constitutional Court Ruling. Finally, the author concludes by emphasizing the need to consolidate the conventionality control as a constitutional mandate in Spain and to ensure consistency with the overall system of law sources, in the interests of the effectiveness of human rights standards and the realization of the pro persona principle.
