| dc.description | The article analyzes how three international treaties—the anti-corruption conventions of the OAS (1996), the OECD (1997), and the UN (2004)—conceptualize corruption, assessing whether their provisions address it as individual conduct, an organized phenomenon, or a hybrid category. Through qualitative content analysis, supplemented by international monitoring reports and cases such as Odebrecht/Lava Jato and fraud involving the Chilean Army, the article examines their legal and practical approaches. The results show that, despite the breadth of their provisions, the conventions largely retain a perspective centered on the individual offender, limiting their ability to address grand corruption and state capture. | en-US |
| dc.description | El artículo analiza cómo tres tratados internacionales —las convenciones anticorrupción de la OEA (1996), la OCDE (1997) y la ONU (2004)— conceptualizan la corrupción, evaluando si sus normas la abordan como conducta individual, fenómeno organizado o categoría mixta. Mediante un análisis cualitativo de contenido, complementado con informes de seguimiento internacional y casos como Odebrecht/Lava Jato y el fraude en el Ejército de Chile, se examinan sus enfoques normativos y prácticos. Los resultados muestran que, pese a la amplitud de sus disposiciones, las convenciones mantienen en gran medida una visión centrada en el infractor individual, lo que limita su capacidad para abordar la gran corrupción y la captura del Estado. | es-ES |
