| dc.description | This article expounds the doctrine of the French theologian iohannes gerson about law, which he identified with a potestas seu facultas, but not limited to that of the rational beings but extended to that of the animals and inanimate ones, under the formula of "there is right as there is entity", which qualifies it as an ontological conception. Such doctrine was accepted and commented by german theologian conradus summenhart, under the formula of "as much of right, as much the action allowed". the ontological conception reappeared in english intellectual thomas hobbes, who, in the natural state, attributes to man as much right as his corporal power reaches to; and appeared again in sephardim-dutch philosopher Baruch spinoza, for whom, in the same state, every being has as much right as his power reaches to. | en-US |
| dc.description | El artículo expone la doctrina del teólogo francés iohannes gerson sobre el derecho, que identifica con una potestas seu facultas, pero no limitada a la de los seres racionales, sino extendida a la de los animales e inanimados, bajo la fórmula de que "tanto hay de derecho cuanto de entidad", por lo cual se la califica de concepción ontológica. Tal doctrina fue aceptada y comentada por el teólogo alemán conradus summenhart, bajo la fórmula de "tanto de derecho, cuanto de acción permitida ejercer". La concepción ontológica reapareció en el pensador inglés thomas hobbes, quien, en el estado natural, atribuye al hombre tanto derecho cuanto alcanza su poder corporal; y volvió a presentarse en el filósofo sefardí-holandés Baruch spinoza, para quien, en el mismo estado, todo ser tiene tanto derecho cuanto alcanza su potencia. | es-ES |
