dc.descriptionNuestra regulación económica se estructura sobre labase de la subsidiariedad y de la libre iniciativa económica conformeal estatuto jurídico previsto en la Constitución Política dela República (CPR). La regla general es que todo emprendimientoeconómico queda subordinado a las normas de derecho comúnaplicables, sin perjuicio de aquellas esferas de la actividad empresarialque por su naturaleza impongan el establecimiento de reglasespeciales. Este régimen especial ha dado origen a nuevas formasde regulación en materia económica, en su gran mayoría con motivode la importación de instrumentos normativos comparados. Así,irrumpe la figura del soft law administrativo a través de la dictaciónde guías, directivas e instrucciones que suelen solapadamente “regular”actividades económicas planteando la disyuntiva de si existerealmente el soft law en nuestro ordenamiento o estamos frente aun hard law exceptuado de mecanismos de control de la actividadformal de la administración.es-ES
dc.descriptionOur economic regulation is structured on the basis ofthe subsidiarity and free economic initiative in accordance withthe legal status provided for in the Constitution. The general rule isthat any undertaking economic is going to be subordinated to therules of common law applicable, without prejudice to those areasof business activity that by its nature imposed the establishment ofspecial rules. This special regime has given rise to new forms ofregulation in the economic sphere, in its great majority on the occasionof the importation of normative instruments compared. Aswell it reinserts the figure of the soft law administratively throughthe issuance of guidelines, directives and instructions that are oftensneak into “regular” economic activities pose a dilemma if there isactually the soft law in our legal system or we will be faced with ahard law exempted from control mechanisms of formal activities ofthe administration.en-US
