The present work has for purpose analyze and commentthe recent judgment dictated by the International Court of Justice onjurisdictional immunity of States, in the case Jurisdictional Immunityof the State raised by the Federal Republic of Germany and theRepublic of Italy. The judgment approaches topics of great currentimportance in the international law such as the scope of the principleof sovereignty of the States in the legal system of the human rightsand the Humanitarian Law. Likewise the Court in this case analyzeagain the subject of the jus cogens norms and its implications in theright of immunity of jurisdiction of the States in processes raised innational courts.El presente trabajo tiene por finalidad analizar y comentar la reciente sentencia dictada por la Corte Internacional de Justicia en materia de inmunidad de jurisdicción de Estados, en el caso Inmunidad Jurisdiccional del Estado planteado por la República Federal de Alemania y la República de Italia. La sentencia aborda temas de gran actualidad en el derecho internacional tales como el alcance del principio de la soberanía de los Estados frente al sistema legal de los derechos humanos y el derecho humanitario. Asimismo la Corte en este caso trata nuevamente la temática de las normas de jus cogens y sus implicancias frente al derecho de inmunidad de jurisdicción de los Estados en procesos planteados ante tribunales nacionales.
