| dc.description | El derecho de propiedad es, sin duda, una de las institucionesque ha provocado una constante preocupación a los estudiososdel Derecho. En este trabajo se presentan algunas consideracionesque pretenden dar cuenta de la conceptuación que estáincorporada en nuestro Código Civil, la cual no puede explicar estainstitución en mayor profundidad, dados los límites que el mismolegislador decimonónico se impuso con la definición del artículo582. Del mismo modo, abordar la propiedad de manera más amplia,abarcando un aspecto social y económico, puede ayudar acomprender de mejor forma su función, no solamente como derechosubjetivo, sino –más bien– como organizador de riqueza social,de acuerdo a los sistemas de propiedad. Si bien, la investigacióntoma como punto de partida el Código Civil, el desarrollo de la mismase extiende en forma más general a otros puntos importantes. | es-ES |
| dc.description | The right of property is undoubtedly one of the institutionsthat has provoked a constant worry for the legal experts. In thispaper, I present some considerations that try to exhibit the conceptualizationincorporated in our Civil Code, which cannot explain thisinstitution in major depth due to the limits that the same nineteenthcenturylegislator imposed himself with the definition of the article582. In the same way, to approach the property more broadly, includingsocial and economic aspects, can help to understand betterits function not only as civil right, but rather as organizer of socialwealth in accord to the systems of property. Although the investigationtakes the Civil Code as a starting point, the development of itextends in general form to other important points. | en-US |
