El autor sostiene que, el patrimonio, como atributo de la personalidad, incluye todos los derechos de las personas, sin excluir los califi cados como morales. Es necesario “corregir” las normas civiles en función de su armonía con el sistema jurídico y, en particular, con nuestra Constitución. Es fundamental concebir como parte del patrimonio de las personas su ámbito moral, pues este puede ser dañado y ello da derecho a reparación. El autor no concuerda con aquella visión que considera que toda reparación pecuniaria que reconozca por causa un daño moral importaría, en último término, un enriquecimiento de la persona que asume el papel de víctima afecta a indemnización, con lo cual se pierde el sentido reparatorio que es propio a esta modalidad de prestaciones. It is fundamental to conceive as part of the persons patrimony its moral area, since this one can be damaged and it gives right to repair. The author does not agree with that vision that considers that any pecuniary repair that should recognize a moral hurt, in last term, would bring an enrichment of the person who assumes the paper of victim sympathetic on indemnifi cation, with which there gets lost the sense of repair that is own to this modality of presentations. The author to establish if his disagreement recognizes or not some worthy foundation, checks some concepts concerning the patrimony of the person and its content.
