dc.description | The main aim of our research is to bring up a brief partof the debate, that for more than three decades, has attracted in Italythe admission of compensation for the damage to health, singularjurisprudence construction whose 6rst intention was the recognitionin the system of the personal injury independently of the classical categoriesof economical and moral damage, and that ended being thenecessary excuse to attack the regulatory rigidity of Article 2059 ofthe Italian Civil Code. dc.description | El principal móvil de nuestra investigación es traer a colación brevemente parte del arduo debate que desde hace más de tres décadas ha concitado en Italia la admisión del resarcimiento del daño a la salud, singular construcción jurisprudencial cuya primogénita pretensión fue el reconocimiento en dicho sistema de los daños corporales en forma independiente de las clásicas categorías de daño patrimonial y moral, y que terminó transformándose en la escusa necesaria para atacar la rigidez normativa del artículo 2059 del código civil italiano. De este modo, la presente exposición versará sobre aquellos puntos que, a nuestro parecer, han sido centrales en la configuración de los denominados daños alla salute y biológico como categorías homologables a los ya conocidos daños corporales, permitiendo defender a este respecto una clara equiparación entre ambas categorías de perjuicios. | es-ES |
