In this study the Author reviews the facts and controversialpoints solved in a judgment of Peru´s Constitutional Court focusedon the property right of an alien inside 50 km from the pointsof Peruvian border. It allows the author present his critical opinionover the interpretation of Peru´s Constitutional Court and the distanceof this judgment from the minimal standard of justice and offundamental rights, that in the international arena are recognized tothe human beings, without considering their origins.En este estudio se pasa revista a los hechos de base y puntos controvertidos resueltos en una sentencia del Tribunal Constitucional (TC) peruano con incidencia directa en el derecho fundamental a la propiedad de los extranjeros dentro de los 50 km. de los puntos de frontera. Ello permite al autor luego realizar alguna reflexión sobre la proximidad o lejanía de la interpretación del Tribunal Constitucional peruano, con el estándar mínimo de justicia y de derechos fundamentales, que en el plano internacional se reconoce a los seres humanos, con total prescindencia de su origen.
