Los autores analizan una perspectiva futura del Derecho Militar en Chile y su importante papel para las Fuerzas Armadas, la Defensa Nacional y Seguridad Nacional. Efectúan sucintamente una prospección, básicamente con la legislación chilena, de los motivos que justifi can el orden jurídico militar, como de igual forma, tratan de abordar un concepto de Derecho Militar, sus características y los contenidos o materias que regula esta rama especializada del Derecho. El orden jurídico militar otorga atribuciones a los cuerpos armados, pero asimismo consagra limitaciones de ejercicio, de tal manera de no afectar los derechos fundamentales. Se resaltan las características del Derecho Militar, que tradicionalmente se han considerado para esta rama, entre ellas, autonomía, especialidad y dinamismo, sin perjuicio que de ellas, la autonomía se conceptualiza con un criterio moderno que impide a dicha organización militar tener un carácter cerrado.The authors analyze a future perspective of the ChileanMilitary Law and its important role for the Armed Forces, NationalDefense as well as National security. They succinctly carry out aprospecting, basically with the Chilean legislation, of the reasonsthat justify the Military Justice System as well as try to cover aMilitary Law concept, its characteristics and the contents or mattersthat regulate this specialized branch of Law. The Military JusticeSystem provides powers to the armed bodies, but at the same timeestablishes limitations on exercise in such a way as not to affect thefundamental rights. The features of the Military Law are highlighted,which have traditionally been considered for this branch, amongthem, autonomy, expertise and dynamism, without prejudice tothem, autonomy is conceptualized with a modern criteria that preventsthe organization from having a closed character.
