En este estudio se analizan los principios fundamentalesdel constitucionalismo moderno que se conformaron como resultadode la Revolución Francesa de 1789, que fueron: la idea de laConstitución para la organización del Estado y como emanaciónde la voluntad popular; la declaración en ella de los derechos delhombre; la asunción de la soberanía por el pueblo; el principio dela representación para su ejercicio; el principio de la separación depoderes para la organización del Estado; la supremacía de la ley yel principio de legalidad; y la distribución territorial del poder y elmunicipalismo. Estos principios influyeron enormemente en la conformaciónde los nuevos Estados hispanoamericano a comienzosdel siglo XIX.This study analyzes the modern constitutionalism fundamentalprinciples derived from the 1789 French Revolution, whichwere: the idea of a Constitution for the organization of the State asexpression of the will of the people; the declaration in it of the rightsof the people; the people’s assumption of sovereignty; the principleof representation for its exercise; the principle of separation of powersfor the organization of the State; the supremacy of the law andthe principle of legality; and the State power territorial distribution,and the municipal government. These principles were fundamentalin influencing the organization of the new Hispanic American Statesat the beginning of XIX century.
