| dc.description | This paper examines the recent doctrinal discussion generatedin the national sphere regarding the possibility that a womancan be charged as the perpetrator of the crime of rape. To dothis, first it determines which place this figure occupies in the systemof crimes related to sexual behavior. It then analyzes the content ofthe typical action of crime, taking account of their relevance to the problem analyzed and developing different thesis that have been outlined on the matter, finishing with the articulation of interpretative variants about the eventual active subject in relation to the three traditional forms of authorship: (i) directly or executive responsibility; (ii) indirect perpetration, and; (iii) co-authorship. | en-US |
| dc.description | El presente trabajo examina la reciente discusión doctrinaria generada en el medio nacional respecto a la posibilidad de que una mujer pueda ser imputada como autora del delito de violación. Para ello, primero determina el lugar que esta figura ocupa en el sistema de los delitos relacionados con el comportamiento sexual. Luego, analiza el contenido de la acción típica del delito, habida consideración de su relevancia para el problema analizado y desarrolla las diferentes tesis que se han esbozado al respecto, finalizando con la articulación de las variantes interpretativas del eventual sujeto activo en relación con las tres modalidades tradicionales de autoría: (i) autoría directa o ejecutiva; (ii) autoría mediata, y; (iii) coautoría. | es-ES |
