| dc.description | RESUMENEl estudio de las teorías de la argumentación constituye uno de los elementos indispensables en la comprensión de las bases teóricas de la argumentación jurídica. Chaim Perelman, desarrolla la teoría de la argumentación retórica que se diferencia de otros tipos de argumentación por estar centrada en el concepto de auditorio universal, que para el autor constituye uno de los presupuestos de la argumentación. El auditorio es concebido como construcción del orador quien debe adaptarse al auditorio para persuadir o convencer. A pesar de las críticas respecto de la ambigüedad del concepto de auditorio universal, es posible extraer conclusiones importantes de la teoría de Perelman. Así, desde la perspectiva jurídica, el orador, el auditorio, el diálogo, la adhesión, son concepciones en cuya virtud, una norma (o regla) puede ser susceptible de generalización si todos están de acuerdo con ella o sus premisas. ABSTRACTThe study of argumentation theories constitutes a fundamental step towards the understanding of the theoretical basis of legal argumentation. Chaim Perelman's rethorical argumentation theory differs from other theories in the sense that it focus on a universal audience, which constitutes one of the assumptions of argumentation. . The audience is conceived as constructed by the speaker who must conform to it in order to persuade or convince. In spite of the criticisms conceming the ambiguity of the concept of universal audience, it is possible to derive some important conclusions from this work. From the perspective of legal argumentation, the speaker, the audience, the dialog, and adherence are conceptions according to which a norm (or regulation) can be generalized if all agree with it or its premises. | es-ES |
