El principio de primacía de la realidad indica que la existencia de una relación de trabajo no depende de los pactos realizados por las partes, ni de la apariencia contractual, ni de las relaciones jurídicas subjetivas, sino, por el contrario, de la situación real en que se halla el trabajador respecto del patrono, de la realidad de los hechos a que aquel se encuentra vinculado y de las situaciones objetivas que surgen indistintamente de la nomenclatura utilizada para defi nir la relación. Este alcance del principio rescata la existencia de la relación laboral aun sobre la voluntad evidenciada por las partes y ello es compatible con el carácter irrenunciable de los derechos laborales y con la índole protectora del derecho del trabajo.The principle of primacy of the reality is that the existence of an employment relationship does not depend on the agreements made by the parties, or the appearance contractual or legal relationships subjective, but on the contrary, the real situation which is the worker and the employer, the reality of the facts to which it is connected and of the situations that arise regardless of the nomenclature used to defi ne the relationship. The scope of the principle rescues the existence of the employment relationship still on the willingness demonstrated by the parties and this is consistent with the inalienable character of labor rights and the protective nature of labor law.
