The article examines the Italian discipline of the accident in itinere, starting from the jurisprudential elaboration to the legislative notion introduced by article 12 of Legislative Decree No. 38 of February 23, 2000, which has collected the results of jurisprudence. It is also reported that the insurance against accidents at work extends to the events that occurred along the route between worker’s house and place of work, independently of the level of risk of the route, but within the limits of reasonableness that lead the worker to the lowest degree of possible risk exposure.El artículo examina la disciplina italiana del accidente in itinere, partiendo de la elaboración jurisprudencial hasta la noción legislativa que introdujo el artículo 12 del Decreto Legislativo N° 38 del 23 de febrero del 2000, que ha recogido, en buena parte, los resultados emanados por la jurisprudencia. Se resalta, como la tutela del seguro contra accidentes de trabajo se extiende a los infortunios ocurridos a lo largo del recorrido que une la casa-habitación del trabajador con su centro de labores, independiente del grado de peligrosidad de la ruta, pero dentro de los límites de la razonabilidad que lleven al trabajador al menor grado de exposición posible del riesgo.
