Se examina la sentencia dictada por la Corte Suprema, que unificó jurisprudencia en torno al artículo 69 letra b) de la Ley 16.744, sobre Seguro Obligatorio por Accidentes del Trabajo y Enfermedades Profesionales. La resolución judicial determinó que las normas que deben regir los reajustes e intereses que incrementan las indemnizaciones por accidentes del trabajo son las del «derecho común» y no aquellas contenidas en el Código del Trabajo (artículos 63 y 173). Se presta especial atención a la aplicación supletoria del Derecho Civil a una materia que forma parte del Derecho del Trabajo.The sentence issued by the Supreme Court is examined, which unified jurisprudence on Article 69 letter b) of Law 16,744, on Obligatory Insurance for Work-related Accidents and Occupational Diseases. The judicial resolution determined that the rules that should govern there adjustments and interests that increase compensation for work accidents are those of the «common law» and not those contained in the Labor Code (Articles 63 and 173). Special attention is paid to the supplementary application of Civil Law to a subject that is part of the Labor Law.
