The article offers a reconstruction of the regulation of the retention of the title clause in the national legal tradition, with the intention of design a conception of property as an atypical warranty for the seller. The central claim is developing a concept of property as a security from the retention of the title clause, overcoming the legal discussions of the article 680 (subsection two) and 1874 of the Chilean Civil Code, through a philosophical-juridical consideration of the scope of atypical security and the effects of fiduciary property.El artículo ofrece una reconstrucción de la regulación de la cláusula de reserva de dominio en la tradición jurídica nacional, con la pretensión de diseñar una concepción de propiedad como una garantía atípica para el vendedor. La tesis central consiste desarrollar un concepto de propiedad como garantía desde la cláusula de reserva de domino, superando las discusiones legales de los artículos 680 inciso segundo y 1874 del Código civil chileno que regulan la materia, a través de una reflexión filosófica-jurídica de los alcances de las garantías atípicas y los efectos de la propiedad fiduciaria.
