| dc.description | El artículo ofrece una reconstrucción de la regulación de la cláusula de reserva de dominio en la tradición jurídica nacional, con la pretensión de diseñar una concepción de propiedad como una garantía atípica para el vendedor. La tesis central consiste desarrollar un concepto de propiedad como garantía desde la cláusula de reserva de domino, superando las discusiones legales de los artículos 680 inciso segundo y 1874 del Código civil chileno que regulan la materia, a través de una reflexión filosófica-jurídica de los alcances de las garantías atípicas y los efectos de la propiedad fiduciaria. | es-ES |
