The French criminal procedure has been modified several times since the 1990's. However, the structural reforms which are necessary have not been carried out yet because of a lack of consensus on the shaping of our future criminal process. Thow key points of the reform analyzed in the article are the abolition of the investigating judge and the modification of the police custodyEl procedimiento penal francés ha sido objeto de numerosas reformas a partir del año 1990. Sin embargo, no se han efectuado todavía las reformas estructurales necesarias por falta de consenso sobre el diseño de nuestro futuro proceso penal. Los dos puntos claves de la reforma analizados en el presente artículo son la suspensión del juez de instrucción y la modificación del régimen de la detención policial.
