Abstract
Recently, in light of the expansion of the legal responsability doctrine and Environmental Law, civil liability for environmental damage has experienced a growing development. Law 19.300, on the General Basis of the Environment dealt with civil liability for environmental damage comprehensibly by setting forth a concept and creating new remedies. Nevertheless, legislative progress is not evident in this field due to the fact that the subjective criterion was finally been adopted and general rules have been accessorily applied. This article explores the regulation contained in Law 19.300, in order to identify the real innovations brought by it into our legal framework, and several problems presented by its interaction with general rules.
