| dc.description | La responsabilidad por daño ambiental, en consonancia con la expansión de la doctrina de la responsabilidad en el derecho y de la disciplina del derecho ambiental, ha tenido un desarrollo creciente. La ley de Bases Generales del Medio Ambiente n°19.300 trató la materia de manera comprensiva, estableceindo un concepto y creando nuevas acciones. Sin embargo, al haberse adpotado finalmente el criterio subjetivo y en virtud de la aplicación accesoria de las reglas generales, no resulta evidente el avance legilsativo. El presente artículo explora la regulación contenida en la ley de Bases, a fin de identificar las innovaciones efectivas que la ley n° 19.300 introdujo a nuestro ordenamiento y algunos problemas que plantea su interacción. | es-ES |
| dc.description | Recently, in light of the expansion of the legal responsability doctrine and Environmental Law, civil liability for environmental damage has experienced a growing development. Law 19.300, on the General Basis of the Environment dealt with civil liability for environmental damage comprehensibly by setting forth a concept and creating new remedies. Nevertheless, legislative progress is not evident in this field due to the fact that the subjective criterion was finally been adopted and general rules have been accessorily applied. This article explores the regulation contained in Law 19.300, in order to identify the real innovations brought by it into our legal framework, and several problems presented by its interaction with general rules. | en-US |
