Abstract
Las cadenas de supermercados que han sido parte en esta causa deben abstenerse de realizar conductas que impliquen alterar ex post y unilateralmente el precio y las demás condiciones de las compras previamente acordadas con los proveedores.
Asimismo, las cadenas de supermercados que han sido parte en esta causa deben establecer en forma objetiva y no discriminatoria las condiciones en las que efectuarán sus compras a los proveedores, debiendo informar a cada uno de ellos, antes de efectuarles compras, cuáles son éstas.
Considerando que AGIP no formalizó una denuncia o demanda por dichos hechos, sino únicamente una consulta, según se lee en su presentación de fojas 25, este Tribunal no aplicará sanción a D & S, pero le previene que debe abstenerse de efectuar prácticas como la indicada.
