The main tenant here is that the 1980 constitution imposed the most radical educational reform in the Chilean history. It generated a break with what the 1925 constitution posed in term of education considered to have “special attention from the State”. On the other hand, the 1980 constitution consider that the State plays a subsidiary role, with private agents at the center of the system. They are expected to be chosen ones to deliver a good quality education as opposed to the bureaucratic and incompetent State. The concept of colonization of the education system is based on the premise that the neoliberal system penetrates and overflows the social system and specifically the education system. This system develops values such as education as consumer good that is invested after which we obtain financial return. Historically, education was considered as a human right, a social right or social good.Se pretende desarrollar como tesis principal que una de las reformas educacionales más radicales en la historia de Chile fue la impuesta por la Constitución de 1980, la que genera un quiebre entre lo que planteaba la Constitución de 1925 que consideraba a la educación como una “atención preferente del estado”, por otra, la de 1980, en la que “el estado cumple un rol subsidiario”, donde  los privados son el centro de todo el sistema, ya que ellos serían los llamados a entregar educación de buena calidad contra un estado “… burocrático incapaz de realizar ese cometido”. El concepto de colonización del sistema educacional se funda en la tesis de que el sistema neoliberal penetra, inunda todo el sistema social y, en nuestro caso, el sistema educacional, desarrollando valores como la educación como un bien de consumo, en donde se invierte en educación para luego tener un retorno monetario, contrariamente a lo que se planteaba históricamente, que consideraba a la educación como un derecho humano, un derecho social, un bien social.
