Abstract
The possibility of the plaintiff to argue that a procedure is not abandoned, due to the diligences deployed before a court of appeals, is analyzed, in spite of the fact that the jurisdiction of the first instance court is not suspended. This is based in two decisions issued by the Supreme Court on the matter. Se analiza la posibilidad que tiene el demandante para defenderse del incidente de abandono del procedimiento, invocando las gestiones útiles realizadas ante una corte de apelaciones, aun cuando la jurisdicción del tribunal de primera instancia no se encuentre suspendida. Ello en base a dos sentencias dictadas por la Corte Suprema.
