The objective is to formulate a critique from the dogmatic parameter, developed in its doctrinal and jurisprudential aspects, to the interpretative thesis that the Chilean Supreme Court has given to article 96 of Decree N° 2.421, in order to obtain a correct interpretation of the regulations, a logical application of the relevant legal institutions, and the due safeguarding of the certainty and legal certainty to which the judgments of the highest Court should aspire.El objetivo es formular una crítica desde el parámetro dogmático, desarrollado en sus vertientes doctrinaria y jurisprudencial, a la tesis interpretativa que ha dado la Corte Suprema al artículo 96 del Decreto N° 2.421, de cara a obtener una correcta interpretación de la normativa, una  aplicación lógica de las instituciones jurídicas pertinentes, y la debida salvaguardia de la certeza y seguridad jurídica a que deben aspirar las sentencias del máximo Tribunal.
