The sentence dictated by the Court of Appeals of San Miguel is examined, which resolved an appeal for labor annulment, rejecting it. With regard to the grounds that led to the filing of the same, said Court ruled on the scope of Article 453 No. 5 of the Labor Code, referred to the exhibition of documents and the faculty of the judge so that, if not presented, considere the allegations of the opposing party. The Court determined that in the case the aforementioned norm was correctly applied. In this regard, attention is paid to the application of procedural collaboration in the labor procedure.Se examina la sentencia dictada por la Corte de Apelaciones de San Miguel, que resolvió recurso de nulidad laboral, rechazándolo. A propósito de las causales que motivaron la interposición del mismo, dicha magistratura se pronunció sobre los alcances del artículo 453 N° 5 del Código del Trabajo, referido a la exhibición documentos y a la facultad del juez para que, en caso de no ser presentados, estime probadas las alegaciones de la parte contraria. La resolución judicial determinó que en el caso de marras se aplicó correctamente la norma ya mencionada. En relación a ello, se presta atención a la aplicación de la colaboración procesal en el procedimiento laboral.
