The purpose of this essay is to address the inclusion of children with disabilities in the educational system, integrating the contributions of the Social Systems Theory to observe this phenomenon. For this purpose, a theoretical review is made around Luhmann's proposal and current policies in education, which include special educational needs (SEN). The idea of this observation is to evaluate inclusion, beyond the ascription to any educational organization, and to include the distinctions and contributions from the systemic theory that could allow to approach the problem with another perspective. The above is framed within the contingency of social movements that aim at the inclusion of individuals in the different systems; discarding the selection based on economic, cultural, and other criteria.El propósito de este ensayo es abordar la inclusión en el sistema educativo de los niños y niñas con discapacidad, integrando los aportes de la Teoría de Sistemas Sociales para observar este fenómeno. Para esto se realiza una revisión teórica en torno a la propuesta de Luhmann y las políticas actuales en educación, que incluyen las necesidades educativas especiales (NEE). La idea de esta observación es evaluar la inclusión, más allá de la adscripción a alguna organización educativa, e incluir las distinciones y aportes desde la teoría sistémica que podrían permitir abordar la problemática con otra perspectiva. Lo anterior se enmarca en la contingencia de los movimientos sociales que apuntan a la inclusión de los individuos en los distintos sistemas; descartando la selección sustentada en criterios económicos, culturales, entre otros.
